20. ACCOUNT RESTRICTIONS, SUSPENSION, AND TERMINATION
20.1. The Service Provider shall reserve the right to restrict, suspend, or terminate a Client's account under the following circumstances:
  • If the Service Provider has reason to suspect that the Client has breached these Terms of Service;
  • If any of the Client's information is found to be unauthorized, incorrect, outdated, or incomplete;
  • If the Client violates relevant laws while using the Platform's Services;
  • If the account is related to any dispute being adjudicated by government authorities, criminal investigations, or other court proceedings;
  • To detect and prevent abnormal activities associated with the account;
  • To detect and prevent unauthorized access to the account holder's account;
  • In accordance with a court decision or the order or requirement of an authorized regulatory body;
  • If the Client directly or indirectly registers on the Platform under someone else's name;
  • If the Client declares non-acceptance of amendments or changes to these Terms of Service; or
  • Other circumstances leading to the Platform's decision to cease services to the Client.
  • 20.2. In the event of account restriction, suspension, or termination, the Service Provider shall have the right to:
  • Immediately suspend the Client's account;
  • Freeze all related account assets;
  • Suspend access to the Platform;
  • Retain and use transaction information and other information related to the Client's account;
  • Erase any or all of the Client's information from the Denode Platform;
  • Inform any counterparties about pending transactions during the account closure process.
  • 20.3. The Service Provider may exercise these rights without notice or liability, at any time in its sole and absolute discretion.
    20.4. Any suspension, termination, or cancellation of a Client's account shall not affect provisions of these Terms of Service, such as indemnification and limitations of liability, that are by their nature intended to survive such suspension, termination, or cancellation.
    20.5. In the event of account closure, the account information will be retained for up to ten (10) years in accordance with relevant laws.
    20.6. Clients may request account closure by writing to support@denode.io. The Service Provider may take up to 30 days to process the termination request.
    20.7. Termination of the Account shall not be effective until the Client has discharged all obligations to any other user or to the Service Provider.
    20.8. The Service Provider reserves the right to refuse or delay account termination if:
  • There are ongoing investigations related to the Client's account;
  • The Client has outstanding obligations to the Service Provider or other users;
  • There are unresolved disputes related to the Client's account.
  • 20.9. The Client acknowledges and agrees that the Service Provider shall not be liable for any losses or damages resulting from account restrictions, suspension, or termination carried out in accordance with these Terms of Service.
